见郭华仁．土著民的植物遗传资源权与传统知识权一文中关于墨西哥干豆事件的介绍．1994年，美国公司POD-NERS由墨西哥买一袋干豆 (Phaseolus vulgaris) 种子，播种后经2年选出黄色种皮的品种“Enola”，随即申请植物专利，而于1999年获得No.5894079的专利，并于同年获得植物品种权利No. 9700027的新品种保护。同年年底，该公司对其他两公司提起诉讼，认为这两家公司由墨西哥进口黄色干豆，已构成侵权，而要求给付权利金。此外，美国关税局也应要求开始在美墨边境检查进口的干豆样品，检查费用则由进口公司负担，因而降低墨西哥农产品的竞争能力。由于这样的专利虽然只适用于美国境内，但是已经使得墨西哥农业蒙受损失，因此引起墨西哥的不满。根据墨西哥的研究，品种“Enola”在遗传上根本就与墨西哥的品种“Azufrado”是一致的。美国学者也认为此项专利所描素的黄色特性根本在墨西哥已经种植了好几已经种植了好几百年，因此给予专利是不适宜的。http://192.192.196.3/npgrc-web/publish/train/train01/class-2.html
